This agreement

These terms are between you and the operators of ProseBird. By signing in or using the service you accept them. If you are using ProseBird as part of a Flourish programme, your tutor's own arrangements with you sit alongside these terms rather than replacing them.

If you do not accept these terms, do not sign in. If a parent or guardian is accepting on behalf of a child, they accept them for that child too.

What ProseBird is

ProseBird takes a piece of writing and returns feedback anchored to the sentences it is about, calibrated to the age of the writer. It is a teaching tool: it explains what a sentence is doing and asks you to attempt the fix before it shows you a worked example.

It is invite-only. There is no sign-up page, and no way to create an account for yourself. A tutor adds your Google address, and until they do, no Google account will get you in.

Accounts

• An account belongs to one person. Do not share it or let anyone else sign in as you.
• Signing in requires a Google account, and keeping that account secure is your responsibility. Anyone who can use your Google account can use ProseBird as you.
• Tell your tutor or write to [email protected] promptly if you think somebody else has used your account.
• The email address on your account must be one you control. You may not sign in with somebody else's address, or attempt to claim a place on the list that is not yours.

Age and parental consent

ProseBird is built for school-age writers, and there is no minimum age to use it. What there is instead is a requirement that an adult put you there: accounts are created by tutors, not by learners.

Where a learner is under eighteen, the tutor or school must obtain consent from a parent or lawful guardian before creating the account. A parent or guardian may withdraw that consent at any time, and the account will be closed. The Privacy Policy sets out how children's data is handled.

Credits

• Each review costs one credit, whether the piece is a paragraph or the full length limit.
• Credits are granted by administrators. They cannot be bought, hold no monetary value, and cannot be exchanged for money or transferred to another account.
• If a review fails before returning anything usable, the credit is refunded automatically.
• Credits exist so that a class cannot run up an unbounded bill. There is also a limit on how many reviews one account may run in an hour.
• Unused credits are not compensated if an account is closed.

Acceptable use

Submit your own writing, and writing you are entitled to submit. Do not use ProseBird to:

• submit anything unlawful, abusive, hateful, or sexually explicit;
• submit other people's personal data, or confidential material you are not entitled to share — remember that submissions are sent to an AI provider for processing;
• infringe anybody's copyright or other rights;
• attempt to gain access to another learner's work, to probe the invite list for who is on it, or to circumvent credit limits, rate limits or authentication;
• use the service through automated means, resell access, or use it as a general-purpose interface to the underlying AI models;
• disrupt the service, or place a load on it that interferes with other people's use.

Practical limits: submissions are capped at 20,000 characters, and uploads must be .txt or .md files. These are enforced by the service, not merely requested.

What the feedback is, and is not

Feedback is generated by a language model. It is a good second reader, not the last word — keep the changes you agree with, and disregard the ones you do not.

Machine-generated feedback can be wrong, can miss things, and can occasionally contradict itself. It is offered as teaching support, and it is not:

• a mark, a grade, or an assessment of ability;
• a qualification, certification, or formal evaluation of any kind;
• professional editorial, academic, legal or medical advice.

You are responsible for what you do with your draft. If you are submitting work for school, a course, or a competition, it is on you to check what their rules say about using a tool like this — ProseBird takes no position on your institution's academic-integrity policy, and cannot absolve you of it.

Your writing stays yours

You keep every right you have in what you submit. We claim no ownership of your writing.

You grant us a limited, non-exclusive licence to store your submissions and their feedback, to send the text to an AI provider in order to produce that feedback, and to show both to you and to your administrators — and to do nothing else with them. We do not publish your work, do not use it to train any model, and do not use it to promote the service.

The feedback text itself is produced by an AI model. You may use it however you like.

Availability and changes

ProseBird is provided as-is and as-available. We do not promise any level of uptime, and it may be unavailable for maintenance, during a provider outage, or without warning.

We may change, add or remove features, change which AI model produces reviews, or discontinue the service. Where a change would meaningfully affect account holders we will give reasonable notice. If we discontinue the service, we will give you a fair opportunity to export your work first.

We may update these terms. The effective date at the top will change, and continuing to use the service after that constitutes acceptance. For a material change we will notify account holders directly.

Suspension and ending your account

An administrator may disable your account — which signs you out and blocks future sign-ins while keeping your work — or remove it entirely. We may suspend access without notice where we reasonably believe these terms have been breached, or where it is necessary to protect other users or the service.

You may stop using ProseBird at any time. Ask your tutor or write to [email protected] to have your account and your writing deleted.

Third-party services

ProseBird depends on Google for sign-in, on an AI provider for feedback, and on cloud providers for hosting. Those services carry their own terms, and we are not responsible for their acts or omissions. An outage or change at any of them may affect your ability to use ProseBird.

Disclaimers and liability

To the fullest extent the law allows, ProseBird is provided without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement.

We are not liable for indirect, incidental, special or consequential loss, or for loss of data, opportunity, marks or reputation, arising from your use of the service. Where liability cannot lawfully be excluded, it is limited to the amount you have paid us for the service — which, for learners, is nothing.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law.

Governing law

These terms are governed by the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts of competent jurisdiction in India.

If any provision is found unenforceable, the rest stays in force and that provision is read as narrowly as needed to make it valid.
